These Terms and Conditions govern your access to and use of Picnique, including our website, mobile experiences, subscriptions, content, recommendations, and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use Picnique.
You must be at least 18 years old and capable of entering a legally binding agreement to create an account or purchase a paid plan. You are responsible for maintaining the confidentiality of account credentials and for all activity under your account.
You must provide accurate and current information and promptly notify us of any unauthorised access, security incident, or suspected misuse of your account.
Registration may require you to submit profile information (for example relationship context, gender identity, age bracket, state, suburb or nearby area, date-night style, and general budget comfort) and to accept our Privacy Policy. Suburb-level information must not be used to misrepresent your location in a way that is false or misleading in a material respect. Optional features may use your device's coarse location solely to suggest a suburb; you remain responsible for reviewing and correcting that information.
By creating an account you acknowledge that we may use profile and usage data as described in the Privacy Policy, including for personalisation, analytics, and commercial data practices where that policy discloses such uses.
Picnique is an informational discovery and planning platform. We provide curated suggestions, editorial content, and links to third-party providers. Picnique does not own, operate, control, endorse, or insure venues, transport providers, restaurants, activity operators, or booking partners.
Content provided through Picnique is general in nature and does not constitute legal, financial, medical, travel safety, or other professional advice. You are responsible for making your own assessments before relying on any recommendation.
The Service may link to third-party websites, apps, or services (including booking and payment providers). Any reservation, booking, purchase, cancellation, refund, dispute, delay, injury, damage, or loss involving a third party is solely between you and that third party under their terms.
Picnique is not responsible for third-party pricing, availability, content accuracy, conduct, service quality, outages, or acts and omissions.
Paid subscriptions renew automatically on the billing cycle selected at purchase unless cancelled before the renewal date. You authorise recurring charges for your chosen plan. Payments are processed by third-party processors such as Stripe, and additional processor terms may apply.
Unless required by law (including under Australian Consumer Law), fees are non-refundable after the relevant billing period starts. Prices, features, and plan inclusions may change with notice where required.
You must not misuse Picnique. Prohibited conduct includes unlawful activity, harassment, infringement of intellectual property rights, unauthorised scraping, reverse engineering, introducing malicious code, interfering with security controls, or attempting to disrupt availability.
We may investigate breaches and suspend or terminate access where reasonably necessary to protect users, the platform, or legal compliance.
Picnique and its licensors retain all rights, title, and interest in the Service, including software, branding, text, design, graphics, and proprietary content, except for third-party and user-submitted material.
Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable licence to access and use Picnique for personal, lawful, non-commercial purposes.
To the maximum extent permitted by law, Picnique is provided on an "as is" and "as available" basis without warranties or representations of any kind, express or implied, including availability, uninterrupted access, fitness for purpose, merchantability, non-infringement, accuracy, or reliability.
We do not guarantee that recommendations, listings, prices, schedules, safety information, or third-party content will be current, complete, or error-free at all times.
To the fullest extent permitted by law, Picnique and its directors, officers, employees, contractors, agents, and affiliates exclude all liability for any indirect, incidental, special, consequential, exemplary, or punitive loss or damage, and for any loss of profits, revenue, goodwill, opportunity, data, business interruption, personal injury, or property damage arising out of or in connection with the Service or any third-party provider.
To the fullest extent permitted by law, Picnique is not liable for claims arising from third-party acts, omissions, delays, failures, cancellations, overbookings, or service quality outcomes, even where linked through the Service.
Where liability cannot be excluded, Picnique's total aggregate liability for all claims relating to the Service is limited to the greater of (a) the amount you paid to Picnique in the three months before the event giving rise to the claim, or (b) AUD $100, and where applicable, our liability is otherwise limited to resupply of relevant services.
You agree to indemnify and hold harmless Picnique and its related bodies corporate, officers, employees, and agents from and against claims, losses, liabilities, damages, costs, and expenses (including reasonable legal costs) arising from your use of the Service, your breach of these Terms, or your dealings with third parties.
We may suspend, restrict, or terminate access to all or part of the Service if reasonably required for security, legal compliance, abuse prevention, non-payment, or operational integrity. Clauses intended to survive termination (including liability and indemnity terms) continue to apply.
We may update these Terms from time to time. Material changes will be posted on this page with an updated effective date. Continued use of Picnique after changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of New South Wales and courts of appeal from them, subject to any rights you may have under mandatory laws.
Nothing in these Terms excludes, restricts, or modifies consumer guarantees, rights, or remedies you may have under the Australian Consumer Law or any other law that cannot be lawfully excluded.
